Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended) following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute.
Background:
The Worker was an employee of the Employer for a little over a year. He was on sick leave from the summer of 2023 before resigning in November 2023. The Worker submitted this trade dispute regarding his sick leave over the course of June/July 2023. |
Summary of Workers Case:
The Worker did not attend the hearing. |
Summary of Employer’s Case:
The Employer did not object to the investigation of the trade dispute and attended the hearing fully ready to defend their position. The Worker was on sick leave until his voluntary resignation from the business. The Employer tried their best to get him back to work safely in complex circumstances. |
Conclusions:
The Worker did not attend the hearing. On review of the WRC’s file, it is clear that the Worker was notified of the hearing at the email address he supplied to the WRC when he submitted his complaint. In the circumstances the complaint must fail. |
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
I recommend that the Employer take no further action.
