Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended) following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute.
Background:
The worker raised a dispute against the employer. |
Summary of Workers Case:
The worker raised a number of issues about her employment. Mainly regarding how she was treated by the Head Chef. She has also raised these issues under a number of pieces of employment legislation. |
Summary of Employer’s Case:
The employer denies any issues arose. |
Conclusions:
In conducting my investigation, I have taken into account all relevant submissions presented to me by the parties. The disputes raised by the complainant were no different than those which were the subject of complaints made under a number of different pieces of employment legislation. These complaints have been investigated and decided upon. In these circumstances I find it is not appropriate to make a recommendation which would overlap with the statutory decisions. |
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute. I can make no recommendation in circumstances where the circumstances of the dispute have been decided and the worker no longer works for the employer.
