BACKGROUND:
The Worker appealed the Adjudication Officer’s Recommendation to the Labour Court on 7 November 202 in accordance with Section 13(9) of the Industrial Relations Act, 1969.
On 16 October 2024 the Adjudication Officer issued the following Recommendation:
“I recommend the employer pay the worker €250 because of its failure to show the minimum respect the worker was entitled to when being dismissed.’’
A Labour Court hearing took place on 4 February 2025.
DECISION:
This matter comes before the Court as an appeal by the worker of a recommendation of an Adjudication Officer given under Section 13 of the Industrial Relations Act, 1969.
The Court is satisfied that both parties were aware of the date, time and venue of the hearing of the Court. No written submissions were provided to the Court in advance of the hearing by the parties notwithstanding extensive contact from the Court in that regard.
Neither party attended the hearing of the Court.
The Court therefore decides that there is no basis to alter the Recommendation of the Adjudication Officer and it is affirmed.
The Court so decides.
