Procedure:
In accordance with Section 79 of the Employment Equality Acts, 1998 - 2015, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
It was the Complainant’s complaint that he was discriminated against on the grounds of his civil status.
Submissions were received from the Complainant in advance of the hearing date which were shared with the Respondent. |
Summary of Complainant’s Case:
After waiting a reasonable period of time, the Complainant did not appear at the hearing. |
Summary of Respondent’s Case:
The owner of the Respondent business appeared at the hearing. It was requested in the circumstances where the Complainant did not attend that the decision be anonymised. |
Findings and Conclusions:
After waiting a reasonable period of time there was no appearance by the Complainant. Following a further review of the file, I am satisfied the Complainant was on notice of the hearing. Additional efforts were made on the hearing day to contact the Complainant but were to no avail. Where the Complainant was on notice of the hearing but did, I attend, I find the Complainant was not discriminated against by the Respondent. For this reason and given the nature of the allegation, the decision has been anonymised. |
Decision:
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
I find the Complainant was not discriminated against by the Respondent. |
