Procedure:
In accordance with section 13 of the Industrial Relations Act 1969 (as amended), this dispute was assigned to me for adjudication by the Director General. A hearing was arranged for December 18th 2024 at 10.30am, for me to make enquiries and for the parties to put forward their positions in relation to the dispute. The managing director of the employer’s company attended the hearing and he was represented by Mr James McEvoy of Work Matters Ireland.
As the subject matter is a dispute under section 13 of the Industrial Relations Act 1969, the parties are not named in this Recommendation, but, in accordance with the Act, are referred to as “the worker” and “the employer.”
At 9.49am on the morning of the hearing, the worker sent an email to the WRC to say that he was unable to attend because he was not well enough. No medical evidence was provided to support this and he did not request a postponement.
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
In the circumstances in which the worker did not attend the hearing, I recommend that the employer takes no further action regarding the matter in dispute. |
