Procedure:
In accordance withSection 39 of the Redundancy Payments Acts 1967 - 2014following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

The Complainant’s role was made redundant but he was not paid his redundancy. |
Summary of Complainant’s Case:
The Complainant commenced his employment with the Respondent on 06.10.2006. In or around May 2024 the owner came to him and told him that the company was in financial difficulty and redundancies were possible. In June he was informed that his position was being made redundant and the warehouse was being sold. He was told that his redundancy would be paid in full. It was not. His employment ended on the 12.06.2024. At the time of his redundancy, he was earning €568.62 |
Summary of Respondent’s Case:
There was no appearance for or on behalf of the Respondent. I am satisfied, having considered the documentation on the case file, that the Respondent was properly on notice of the hearing date, time and venue. I am satisfied that the hearing link was sent to the Respondent also. |
Findings and Conclusions:
The Complainant commenced working for the Respondent on the 06.10.2006. His position was made redundant, and his employment formally ended on the 12.06.2024. His salary was €568.62 weekly. He had no breaks in his service. I am satisfied that the Complainant is entitled to a redundancy payment based on the following information: Start date: 06.10.2006 End date: 12.06.2024 Salary: € 568.62 |
Decision:
Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
The Complaint is well founded. The Complainant is entitled to a redundancy payment in the terms as set out above. |
