Procedure:
In accordance with Section 39 of the Redundancy Payments Acts 1967 - 2014following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant worked in Kanoodle a takeaway based in Clontarf. Her employment began on the 22nd of February 2019. In December 2021 the Complainant was placed on layoff to facilitate a refurbishment of the business. It was originally planned to be for a month. In April 2021 the Complainant in her application stated that she contacted the owner about redundancy as there was no sign of the business reopening. This Complaint was lodged with the Commission on the 30th of December 2022. An issue arises concerning time to make a complaint to the Commission. However, the Complainant did not attend at the hearing to address that or the substantive claim. |

Findings and Conclusions:
The Complainant was notified of the date, time and place of the hearing at the address detailed on her complaint form. As she has failed to attend at the hearing to present her case, I must dismiss for failure to attend. |
Decision:
Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
The Complainant failed to attend at the hearing, and I dismiss her appeal arising from the fact that she failed to attend at the hearing. I find that the complaint is not well founded. |
