Procedure:
A complaint was received by the Director General of the Workplace Relations Commission on 24 July 2024 from Mr. Hussain Zaidialleging that he was discriminated against by Mt. Paul McCracken of Hotel Riu Plaza, The Gresham. His complaint was submitted under Section 21 of the Equal Status Act, 2000. The said complaint was referred to me for investigation.
A hearing for that purpose was convened on 9 December 2024.
There was no appearance by or on behalf of the complainant at the hearing nor was there an appearance by or on behalf of the Respondent.
Decision:
Section 25 of the Equal Status Acts, 2000 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 27 of that Act.
Neither party attended the hearing. In those circumstances I confirmed that the notice of the hearing had issued to both parties in advance of the hearing.
I noted that the correspondence containing details of the hearing was issued to the Complainant to the address provided on his complaint form and that the notice was also copied to him by email to an email address provided by him. I established that the address to which the Respondent correspondence had issued was the address listed for the Respondent on the website of the Companies Registration Office.
On the day of the hearing, I awaited the attendance of the parties for in excess of 20 minutes and I allowed 7 days from the day of hearing for either party to make contact with the WRC post hearing before finalising this decision. No contact was made.
As no further communication was received at the time of finalising this decision and in the context that I am satisfied that the said complainant was informed in writing of the arrangements for the hearing and in the absence of any explanation for his non-attendance and the absence of evidence to the contrary having been adduced before me, I must conclude that the within complaint is not well-founded and I decide accordingly.
