Procedure:
This complaint was submitted to the WRC on September 16th 2024 and, in accordance with section 41 of the Workplace Relations Act, it was assigned to me by the Director General. A hearing was arranged for January 10th 2025 for the parties to present evidence in respect of the complaint. At 6.28 on the morning of the hearing, the complainant, Mr Sherwi, sent an email to the WRC to say that he couldn’t attend the hearing because he was very sick. Mr Sherwi did not provide a medical certificate with any evidence of his illness and he did not submit a postponement request in accordance with the WRC’s standard procedure.
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
In the circumstances where the complainant did not attend the hearing and, in the absence of any evidence to the contrary having been presented, I must conclude that this complaint under the Payment of Wages Act 1991 is not well-founded and I decide accordingly. |
