Workplace Relations Commission Adjudication Officer: Monica Brennan
Date of Hearing: 17/01/2025
Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended)following the referral of the disputes to me by the Director General, I gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute.
Background:
The dispute was received by the Director General of the Workplace Relations Commission on 22nd October 2024. The complaint form stated that the dispute was in relation to training that had been provided. A hearing was scheduled for 11.30 am on Friday 17th January, 2025 in Lansdowne House, Ballsbridge, Dublin 4. At the time the hearing was to commence, it was apparent that there was no attendance by or on behalf of either the Worker or the Employer. I verified that both parties were on notice of the date, time and venue of the hearing and waited some time to accommodate late arrivals. |
Summary of Workers Case:
The Worker did not attend the adjudication hearing and was not represented. Notice of the hearing arrangements was sent to the Worker on 27th November 2024. |
Summary of Employer’s Case:
The Employer did not attend the adjudication hearing and was not represented. Notice of the hearing arrangements was sent to the Employer on 27th November 2024. |
Conclusions:
The hearing was scheduled for 11.30am on Friday 17th January, 2025. At the appointed time, there was no appearance by either the Worker or the Employer. I satisfied myself that both parties were on notice of the date, time and location of the hearing. I also made enquiries to ensure that no communication had been received from either party on the morning of the hearing. I allowed 20 minutes for the late arrival of either party. In the circumstances, I must conclude that the Worker does not wish to proceed with the dispute. |
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
In all of the circumstances, I do not recommend in favour of the Worker as there was no appearance to advance the dispute on the day of the hearing. |
