Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
There was no appearance by the Complainant at the hearing.
Mrs. Sinead Byrne, wife of the Respondent, attended on behalf of the Respondent. |
Summary of Complainant’s Case:
After allowing a reasonable period of time, there was no appearance by the Complainant. Having reviewed the file, I am satisfied that the Complainant was duly notified of the hearing. Accordingly, I proceeded with the hearing in his absence. |
Summary of Respondent’s Case:
Ms Byrne attended and advised the Complainant worked for 3 days and not 5 days as complained off. In the absence of a PPS number, she was unable to pay him the wages for 3 days and has been unable to contact the Complainant. |
Findings and Conclusions:
In the absence of an appearance of the Complainant I find the Act was not contravened. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
I find the Act was not contravened. |
