Complaint seeking adjudication by the Workplace Relations Commission under Section 8 of the Unfair Dismissals Act, 1977 | CA-00064794-001 | 16/07/2024 |
Date of Adjudication Hearing: 05/02/2025
Workplace Relations Commission Adjudication Officer: Dónal Moore
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 8 of the Unfair Dismissals Acts, 1977 - 2015, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
This complainant sought adjudication by the Workplace Relations Commission under Section 8 of the Unfair Dismissals Act, 1977. The Complainant did not present on the day and repeatedly offered to contact the Commission but failed to do so. |
Summary of Complainant’s Case:
The complainant did not attend the hearing of this matter. |
Summary of Respondent’s Case:
The Respondent representative and three witnesses attended the hearing |
Findings and Conclusions:
The Complainant failed to appear at the time of the hearing and the Adjudication Officer waited enough time to allow him to appear or offer a reason for non-appearance. I am satisfied that he was properly on notice of the hearing date and time to the correspondence address that he provided. I have concluded that complainant had no valid reason for non-attendance and not having attended or offered a reason for non-attendance his complaint fails. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
Having regard to all the circumstances of this case, my decision is that the complainant was not unfairly dismissed and that this complaint is not well founded. |
