Procedure:

In accordance with Section 41 of the Workplace Relations Act, 2015following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

Background:

This Complaint seeking adjudication by the Workplace Relations Commission under section 7 of the Terms of Employment (Information) Act, 1994 was not pursued in that the Complainant did not attend the hearing

Summary of Complainant’s Case:

The complainant did not attend the hearing.

Summary of Respondent’s Case:

The respondent attended the hearing with their representative.

Findings and Conclusions:

The Complainant did not attend the hearing.

I am satisfied that he was on notice of the hearing.

As the Complainant did not attend the hearing and provided no explanation for his non-attendance, I find that he has not established that the Act was contravened.

Having regard to the circumstances of this case that Mr Duignan did not attend and offered no explanation despite the best efforts of the Respondent and the Commission, my decision is that the complaint is not well-founded.

Decision:

Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.

I have decided the complaint is not well founded.
