Procedure:
In accordance with section 13 of the Industrial Relations Act 1969 (as amended), this dispute was assigned to me for investigation by the Director General. A hearing was arranged for Friday, March 7th 2025 at 11.00am. The employer was represented by the managing director and he was accompanied by a manager. By 11.30am, the worker had not arrived for the hearing and he did not contact the WRC to explain the reason for his non-attendance.
The documents on the case file include a copy of a letter sent to the worker by registered post on January 31st 2025, notifying him of the date and time of the hearing on March 7th. The letter was not returned to the WRC. I am satisfied therefore, that the worker had five weeks’ notice of the hearing and, in the absence of any explanation for not attending, I have reached the conclusion below.
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
In the circumstances in which the worker did not attend the hearing, I recommend that the employer takes no further action regarding the matter in dispute. |
