Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant alleged the following:
“After working for the company for a week, I was asked to sign a contract. However, I was never given a copy of that contract. On 7 October, I emailed the company to ask to be given a copy of my contract. However, they have never given it to me”
Solicitors came on record, attended the hearing; however, wrote to the WRC prior to the hearing that they would be coming off record.
The Complainant agreed to be communicated by email and failed to attend at the hearing. I am satisfied that he was properly notified of the date time and place of the hearing. |
Summary of Complainant’s Case:
The Complainant failed to attend at the hearing to make out his case. |
Summary of Respondent’s Case:
The Respondent failed to attend at the hearing; although, a solicitor did attend, a letter on file stated that the solicitor had come off record. |
Findings and Conclusions:
The Complainant failed to attend at the hearing and therefore his claim must fail. I am satisfied that he was notified by email, with his agreement, about the date, time and place of the hearing. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
As the Complainant has failed to attend at the hearing, I must dismiss his claim for failure to attend. I determine that the complaint is not well founded. |
