Procedure:
This complaint was submitted to the WRC on October 30th 2024 and, in accordance with Section 41 of the Workplace Relations Act, it was assigned to me by the Director General. A hearing was arranged for Monday, March 3rd 2025 at 9.30am, for the parties to present evidence in respect of the complaint; however, neither the complainant nor the respondent attended at the appointed time. Having checked the case file, I established that both parties were properly on notice of the hearing. By 10.00am, neither party was present.
On March 4th 2025, the complainant wrote to the WRC seeking a postponement of the hearing scheduled for the previous day. As the hearing date had passed, and, as the complainant did not follow the procedures for seeking a postponement, a postponement has not been granted.
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
In the circumstances in which the complainant and the respondent did not attend the hearing, and in the absence of any evidence to the contrary having been submitted, I must conclude that this complaint is not well-founded and I decide accordingly. |
