Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended) following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute.
Background:
The Worker was a Project Manager with the Employer from 17 January 2022 until he resigned from his employment on 31 May 2023. |
Summary of Workers Case:
The Worker outlined his dispute which related to his meal allowance. He outlined that he was away once a week from his workplace for between 11 – 12 hours a day but did not receive a meal allowance from his Employer. |
Summary of Employer’s Case:
The Employer responding by stating this dispute had not been raised before by the Worker. |
Conclusions:
In conducting my investigation, I have taken into account all relevant submissions presented to me by the parties.
I have no jurisdiction to make a Recommendation in respect of this dispute where no formal grievance was raised, and internal procedures were not followed. |
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
