Procedure:
In accordance with section 25 of the Equal Status Act 2000, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard and to present any evidence relevant to the complaint.
On 23rd March 2025, the Complainant presented a complaint to the Workplace Relations Commission (WRC). This complaint was scheduled for adjudication on 9th October 2025 at the hearing rooms of the WRC Office in Carlow. There was no appearance by or on behalf of the Complainant or the Respondent at the hearing. I verified that the Complainant and the Respondent had been served with notice of the time, date, and venue of the adjudication hearing. I waited some time to accommodate a late arrival. As there was no appearance by the Complainant or the Respondent, I closed the hearing.
On 14th August 2025 the Complainant’s representative wrote to the WRC to advise that the Complainant would be making a preliminary objection at the hearing on 9th October 2025 in relation to the proposed venue for the hearing on the following grounds: (i) “the defendant is incompetent, misconceived and otherwise an abuse of the due process of this scheduling venue at WRC Carlow”, and (ii) “this venue WRC Carlow lacks the requisite jurisdiction to entertain the said defendant as contained in the Court Act 1972 and Civil Procedure Act”. The WRC contacted the Complainant’s representative on receipt of the email seeking clarity on the nature of the objection. The Complainant’s representative committed to sending further detail, however no further information was received by the WRC in this regard. There was no appearance by or on behalf of the Complainant at the hearing. No further contact was received by or on behalf of the Complainant in the days following the scheduled hearing to indicate any difficulty with attending the hearing.

Findings and Conclusions:
As the Complainant did not attend the adjudication hearing to set out how the Respondent contravened the Equal Status Act 2020, I find the Respondent did not engage in prohibited conduct. |
Decision:
Section 25 of the Equal Status Acts, 2000 – 2015 requires that I decide in relation to the complaint in accordance with the relevant redress provisions under section 27 of that Act.
