Procedure:
In accordance with Section 25 of the Equal Status Act, 2000,following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
The Complainant submitted a complaint to the WRC on 24 November 2023 alleging that he was discriminated against by the Respondent on the grounds of his sexual orientation. Although I am satisfied that he was on notice of the time and date of the hearing, he did not attend on the day to give evidence. The Respondent was in attendance accompanied by their representative.
Findings and Conclusions:
As the Complainant failed to attend the hearing to give evidence, I find that a prima facie case of discrimination has not been established. |
Decision:
Section 25 of the Equal Status Acts, 2000 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 27 of that Act.
As the Complainant failed to establish a prima facie case of discrimination, I find that the Respondent did not engage in prohibited conduct. |
