Workplace Relations Commission Adjudication Officer: Breiffni O'Neill
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.
Although I am satisfied that the Complainant was on notice of the time and date of the hearing, he did not attend on the day to give evidence in relation to the complaints.
Background:
In his complaint form submitted to the WRC, the Complainant stated in the first instance that he was not paid in respect of all of the hours that he worked for the Respondent. He also stated that he did not receive his full holiday entitlements. |
Summary of Complainant’s Case:
The Complainant did not attend on the day of the hearing to give evidence in relation to his complaints. |
Summary of Respondent’s Case:
As the Complainant did not attend on the day of the hearing to give evidence, the Respondent did not present any evidence. |
Findings and Conclusions:
As the Complainant did not attend the hearing to give evidence, I find that these complaints are not well founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
I find that these complaints are not well founded for the reason set out above. |
