Workplace Relations Commission Adjudication Officer: John Harraghy
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant submitted a complaint to the WRC on 07/10/2025 against the Respondent under the payment of wages acts. This complaint was acknowledged on 24/10/2025. |
Summary of Complainant’s Case:
The Complainant submitted a complaint to the WRC on 07/10/2025 against the Respondent under the payment of wages acts. This complaint was acknowledged on 24/10/2025. The Complainant was notified of the date, time and venue of the hearing on 31/03/2026. The Complainant or a representative on his behalf did not attend the hearing. |
Summary of Respondent’s Case:
The Respondent was notified of the complaint on 08/10/2025. The Respondent was notified of the date, time and venue of the hearing on 31/03/2026. The Respondent did not attend the hearing. |
Findings and Conclusions:
The Complainant provided an email address on their complaint form when he lodged their complaint on 07/10/2025 and gave the WRC permission to notify them of the hearing date via that email address. A hearing notification was sent to that same email address on 31/03/2026. In the circumstances I am satisfied that the Complainant was on notice of the hearing and failed to attend. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
The complaint is not well founded. |
